In consideration for my agreement to the terms contained in this Agreement, Midwest Recruiters will consider me for employment, which may lead to possible hire and compensation. I certify that my answers and assertions in this application, my resume and any other materials I have submitted to Midwest Recruiters are true and complete to the best of my knowledge. If this application leads to employment, I understand that false or misleading information in these materials or resulting interview will result in termination.
I request that previous employers contacted by Midwest Recruiters in connection with this application fully respond to all inquiries concerning previous employment, and I specifically waive prior written notice of disclosure of my personnel record information, including salary information, disciplinary records, and job performance. In consideration of the acceptance of my application, I release Midwest Recruiters, its agents, and previous employers of any claimed liability arising out of such response and disclosure.
I agree that, unless prohibited by state law, not to file any action, suit, charge, or other legal proceeding relating to employment or application for employment with the Midwest Recruiters and/or its predecessors, successors, assigns, subsidiaries, parent(s), affiliates, and all past and present officers, directors, employees and agents, in their individual and representative capacities of the foregoing entities relating to his/her application for employment, employment or termination thereof, more than 180 calendar days after
the event and/or employment practice or action complained of and agree to waive any statute of limitations to the
contrary (except those requiring a shorter period) to the extent permitted by law. While I understand that the statute of
limitations for claims arising out of an employment action may be longer than 180 calendar days, I agree and understand that any Midwest Recruiters action that is the subject of a lawsuit or action, including those related to discrimination, benefits, termination of employment, or other terms or conditions of employment, is barred if it is not filed within the 180-day period (or in less time if any applicable law so requires) and understand and agree that the 180-day period (or applicable shorter period) will not be extended for any reason, including continuing violations and agree to waive the application of continuing violations doctrines.
This policy does not prohibit the timely filing of a charge of discrimination, retaliation or harassment under Federal law with an administrative agency and the right to investigate is maintained.
Except for claims requiring a “Notice of Right to Sue” from the EEOC prior to filing a formal lawsuit (“RTS Claims”), filing a charge or claim with an administrative agency, including the EEOC or internally agree that: (a) any filing does not toll (hold in abeyance) the 180-calendar day period for filing of a civil suit; and (b) if I wish to obtain individual relief, understand that any lawsuit must be filed within 180 days (or applicable shorter period) of the complained of action. For RTS Claims, if I timely file a charge of discrimination, retaliation or harassment under Federal law with the EEOC, then I must file suit prior to the first to occur of either: (a) 90 calendar days after the EEOC issues a “Notice of Right to Sue” letter for the claim; or (b) three hundred (300) calendar days of the complained of action.
I understand that completing this Employment Application and Applicant’s Certification and Agreement does not constitute an offer or promise of employment.
If employed, I understand that I must abide by all rules, policies and procedures of Midwest Recruiters.
If employed, I agree that my employment with Midwest Recruiters is at-will and can be terminated at any time, with or without cause and with or without notice at the option of either Midwest Recruiters or myself.
